DMS Progrowers Limited its related bodies corporate, officers, employees, agents and contractors DMS Progrowers Limited, ‘our’, ‘us’ or ‘we’) are committed to ensuring that your personal information and privacy is protected in accordance with the requirements of the New Zealand Privacy Act 2020 (the Act).

Personal information is information about an identifiable individual (a natural person). This policy sets out how we will collect, use, disclose, store and protect your personal information. This policy does not limit or exclude any of your rights under the Act. Our Privacy Policy applies to any individual whose personal information we currently hold, or whose personal information we may in the future collect, including, without limitation, users of our website, users of our DMS Reporting mobile application available on the Google Play Store and operated by DMS Progrowers Limited (the “App”), users of our recruitment system, and our customers.

Who do we collect your personal information from?

We may collect personal information about you from:

  • you, when you provide your personal information to us, including via the website, the App and any related service, our recruitment system, any registration or subscription process, any contact with us (e.g. telephone call or email), or when you buy or use our services and products;
  • third parties where you have authorised this, where the information is publicly available, or where the information will not be used in a form in which you are identified (for example, where we use anonymised personal information to analytics purposes, or for statistical or research purposes).

If possible, we will collect personal information from you directly. 

How we collect your personal information

We receive both information that is directly provided to us, such as personal information you provide when you visit our website or access our services, and information that is passively or automatically collected from you, such as anonymous information collected from your browser or device.

What type of personal information do we collect?

We may collect and hold personal information which is relevant to providing our services to you, including, but not limited to:

  • contact details including your name, postal and email address, contact phone numbers;
  • proof of identification documents such as a driver’s licence or passport;
  • details about your personal requirements and preferences in relation to our products or services;
  • financial information including invoicing and bank account information, and credit history;
  • information collected through our mobile App, including login credentials, usage data, activity within the App, information you input into the App (e.g. reporting data, job records, and operational information);device and technical information such as device type, operating system, app version, unique device identifiers, IP address, URLs of pages visited, browser details, search engine details, dates and times of access to our website, App or recruitment system, cookies, pixel tags;
  • information collected through our recruitment system including CVs/resumés, qualifications and experience, work history, testimonials and references, and any other information you input into the recruitment system;
  • information collected in relation to visitation of our work premises or attendance at events hosted or sponsored by DMS, for example sign-in details, photographs, attendance lists, and dietary requirements;
  • any other information that you may provide to us, either directly or through our website, App, recruitment system or via our representatives; and
  • any additional information necessary to deliver our products and services to you or engage with you.

This is not an exhaustive list as we may be required to collect further information in fulfilment of our services to you.

How we use your personal information

We may use your personal information to provide and market our products and services, to operate our business, to further our relationship with you, to enforce our Terms and Conditions and any lawful rights we may have, to comply with applicable legal requirements and industry standards, and to recruit and employ staff or engage contractors.

We may use personal information for other lawful purposes connected to our business. We will identify these additional purposes at the time of collection.

We also reserve the right to transfer personal information we have about you to the new owner in the event that we sell or transfer all or a portion of our business.

Statistical information, cookies and analytics

We use analytic tools to collect statistical information about your visit to help us improve our website.

This information is aggregated and does not identify you personally. It includes:

  • your IP address
  • the search terms you used
  • the pages you visited on our site and the links you clicked on
  • the date and time you visited the site
  • the referring site (if any) from which you clicked through to this site
  • your operating system, for example Windows, MacOS
  • the type of web browser you use, such as Chrome, Internet Explorer or Mozilla Firefox
  • other things like your screen resolution and the language setting of your browser.

Our website site generates persistent session cookies (that is, they have an expiry date and are removed on that date) for the purpose of monitoring site usage. The cookies do not collect identifying personal information. They provide details of your IP address, the computer platform that you use (eg Mac or Windows), the browser that you use (eg Microsoft Explorer or Netscape) and what domain you are accessing our sites from. We also use pixel tags and other tracking technologies such as Google Analytics and Facebook Analytics.

With this information we can:

  • Track traffic patterns to our site.
  • Understand how our website is performing and improve and customise the content or offerings, including ensuring that the most relevant content is being shown.
  • Allow you to enter certain site member services without having to log in each time you visit.

Most web browsers are set up to accept cookies. You can usually disable cookies by changing the settings on your browser. You will still be able to use our sites with cookies disabled, although this may mean that you cannot use all of the features of the website.

The analytics information we collect may be stored on servers located outside of New Zealand, such as the United States and Australia.

  • any business that supports our services and products, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website or other services and products.   • other third parties (for anonymised statistical information)

  • third-party service providers that support the operation, hosting, and functionality of our mobile application;
  • any other person authorised by you.

We will at all times ensure the Principles of the Act are adhered to when providing any personal information to third parties, including third parties outside New Zealand.

Protecting your personal information

While we take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse, we cannot guarantee that transmission of information via the internet will be totally secure. If you provide us with personal information over the internet, the provision of that information is at your own risk.

If you follow a link on our website to another site, the owner of that site will have its own privacy policy relating to your personal information.  You should review that site’s privacy policy before you provide any identifying personal information.

Right of access to, and correction of, personal information

Under the Privacy Act 2020, you have the right to access, and the right to request correction of, any of your personal information held by us. We may require proof of your identity before being able to provide you with any personal information.

We may charge a fee in connection with providing access to, or correcting, your personal information.

Use of our Mobile Application and account deletion

This Privacy Policy applies to use of our App including but not limited to “DMS Grower Reporting”

When you use our App, we may collect, use, and store personal information in the manner and for the purposes described in this Privacy Policy, including when you log in, submit data, or interact with App features,

Account deletion

You may request deletion of your account and associated personal information at any time by:

  • contacting us using the details set out in the ‘Contact us’ section below.

To process your request, we may require verification of your identity.

Once your request is verified, we will:

  • delete your account; and
  • delete or de-identify your personal information, except where we are required to retain it for legal, regulatory, or legitimate business purposes.

  • your login details and account profile information;
  • personal contact information;
  • data you have entered into the App (where not required to be retained).

We may retain certain information where necessary, including:

Any retained data will be securely stored and deleted when no longer required.

Use of our recruitment system and account deletion

This Privacy Policy applies to use of our recruitment system.

When you use our recruitment system, we may collect, use, and store personal information in the manner and for the purposes described in this Privacy Policy, including when you log in, submit data, or interact with the recruitment system features.
